THEHEALTHREAD AND ALL CONTENT, SERVICES, AND INFORMATION PROVIDED ON THE SITE ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTY OF ANY KIND, WHETHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, ADSCONSULTANT, MB DISCLAIMS ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

7. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ADSCONSULTANT, MB AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES — INCLUDING LOSS OF PROFITS, DATA, OR GOODWILL — ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF, OR INABILITY TO USE, THEHEALTHREAD OR ITS CONTENT, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
In jurisdictions that do not allow the exclusion or limitation of liability for certain damages, our liability is limited to the fullest extent permitted by law. In no event shall our aggregate liability to you exceed the greater of (a) the amount you paid us (if any) in the twelve months preceding the claim, or (b) one hundred euros (€100).
8. Third-Party Links & Advertisements
thehealthread contains links to third-party websites and displays advertisements for third-party products and services. These links and advertisements are provided for your convenience and informational purposes only. We do not endorse, control, or assume any responsibility for the content, privacy practices, or offers of any third-party site or advertiser.
Your interactions with third-party sites and advertisers — including any purchases, contracts, or disputes — are solely between you and those third parties. We encourage you to review the terms and privacy policies of any third-party site you visit.
9. Binding Arbitration & Class-Action Waiver
Except as otherwise provided in these Terms or required by applicable law, any dispute, claim, or controversy arising out of or relating to thehealthread or these Terms (a "Dispute") shall be resolved exclusively through binding individual arbitration, not through the courts. By agreeing to these Terms, you and Adsconsultant, MB each waive the right to a jury trial and to participate in a class action, class arbitration, or any other representative proceeding.
Arbitration shall be conducted by a recognized arbitration body under its then-current rules. Either party may seek emergency injunctive relief in a court of competent jurisdiction solely to prevent irreparable harm while arbitration is pending. Before initiating arbitration, the claimant must provide written notice of the Dispute to the other party and allow 30 days to attempt informal resolution.
Nothing in this section prevents either party from seeking relief in small-claims court for disputes within that court's jurisdiction, or from filing a complaint with a relevant regulatory authority.
10. Governing Law
These Terms, and any Dispute arising out of or related to them or your use of thehealthread, shall be governed by and construed in accordance with the laws of Lithuania, without regard to its conflict-of-laws principles.
Subject to the arbitration clause above, you consent to the exclusive jurisdiction of the courts located in Lithuania for the resolution of any dispute that is not subject to arbitration.
11. General
Entire agreement. These Terms, together with the Privacy Policy and any other policies or notices posted on thehealthread, constitute the entire agreement between you and Adsconsultant, MB concerning the site and supersede all prior agreements, understandings, and representations.
Severability. If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision shall be modified to the minimum extent necessary to make it enforceable, or severed if modification is not possible, and the remaining provisions shall continue in full force and effect.
No waiver. Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision in the future. Any waiver must be in writing and signed by an authorized representative of Adsconsultant, MB to be effective.
